Arizona MVD Regulations for Selling Cars

Purchasing a used car from a private seller is often a good way to save money, but it has its risks. To protect yourself, you should cover the obvious bases by test-driving the automobile and having a trustworthy mechanic inspect it.


In addition, you should examine the title of the vehicle for the following warning signs:

  • Match the vehicle identification number (VIN) on the title with the one on the vehicle. The VIN number is usually on the dashboard just below the glass. If they do not match, you will have problems registering the vehicle with the MVD.

  • Look for the type, status, or brand of the vehicle on the title. If the words "dismantled" or "salvage" appear, you could be dealing with a vehicle that has been created using stolen parts from other vehicles.

  • Look for the word "reconstructed" or "homemade" on the title. If the car has been specially constructed or built from scratch, it may be missing a VIN, so you will have problems registering it with the MVD.

  • Check to make sure that the lienholder on the title is the person you are dealing with. If they are not, you will need a notarized release from the lienholder.

  • Confirm that there is only one person listed as the owner of the vehicle. If there are multiple owners, you will need all of their signatures to release the vehicle to you.

Title-Holding Details


The holder of the title is the owner of the vehicle in the state of Arizona. If you pay for the vehicle in full at the outset, you should receive the title from the seller to take to the MVD. It will need the seller's signature notarized.


However, if you plan to pay for the vehicle in installments, the vehicle's seller will hold the title of the vehicle until you pay it off. They will put their own name on the title as a lienholder until you do. This will allow you to register the car in your name which you must do in person at a local MVD office within 15 days of purchasing it. When you have paid for the vehicle in full, the seller will document it on the title, have it notarized, and mail it to you.


The seller must provide the title at the time of delivery of the vehicle. If the lienholder still has the title, the seller must first obtain it from the lienholder. If the seller has lost the title, he or she must obtain a duplicate from the MVD before the sale can proceed.


However, if you're selling your vehicle to a dealer but the lienholder still has the title, the dealer will have you sign a Dealer Acquisition Contract in order to complete the sale.


A seller doesn't need to produce the vehicle registration at the time of the sale. But showing it to a prospective buyer might help facilitate the sale. For example, the buyer might be able to verify that the tags are legitimate, and that the vehicle has passed recent emissions tests.


Bills of Sale and Sold Notices


Acquiring valid proof of the sale in the form of a Bill of Sale will help ensure that your registration, insurance, and titling go smoothly. Even though the Motor Vehicle Division (MVD) does not require that you file the Bill of Sale, having the signatures of both you (the buyer) and the seller on a single notarized document will alleviate any confusion about the legitimacy of the transaction.


Likewise, if you sell an automobile in a private transaction, you can submit a Sold Notice online to inform the MVD that you have done so. The submission will limit your liability if the new owner drags their feet in registering the vehicle with the MVD under their name (they have 15 days to do so).

License Plate Refunds for Vehicle Sellers


Private vehicle sellers may be eligible to receive refunds on fees associated with the license plates of the vehicle they sell because license plates belong to people, not vehicles. To see if you qualify for reimbursement, you can utilize the online Plate Refund tool.

    When is the best time to sell a house in Arizona?


    Probably one of the most frequently asked questions I receive from sellers contemplating selling their homes is “when is the best time to sell a house in Arizona?” The flippant answer would be “um…yesterday”.

    But let’s contemplate this as we roll into the upcoming holiday season…which I might add seems to come earlier every year. Truly a contradiction to my senses as I stroll the Halloween candy aisle basking in the glow of decorated Christmas trees and the tinkling sound of Christmas carols playing one aisle over….but I digress.


    Is there a “better” time to sell a home in Arizona? Well, historically the first 3 months of the year are considered our “high” season. Most folks want to wait to make their real estate decisions until the holidays are over which accounts for the steep rise in new listings right after January 1. But, just because there are more listings…doesn’t mean that’s the best time to sell. Obviously, more listings means more competition for a seller.

    April-June is our second most active real estate period. Temps are still moderate and relocation opportunities typically coincide with school summer vacation.


    July-September ranks #3 in real estate activity. Why? It’s HOT. Driving from property to property wearing oven mitts isn’t my idea of a good time and the same holds true for most buyers. Sellers typically see a slowing of showings during the heat of our desert summers and it’s no surprise.


    Finally the holiday season of October-December. Slowest real estate season of the year. BUT…that doesn’t mean homes don’t sell. There are usually fewer homes on the market during the holidays. So if you have an awesome house to sell, chances are even greater that it will stand high above limited competition.


    With our current market however, my answer to the question “When is the best time to sell a house in Arizona” is…”As soon as you can…but only if you have to”. Our prices are still trending downward which means waiting even 3 months to put your home on the market can mean a significant net loss. Now, if you decide to sell your home and it happens to be December 18th…I would suggest waiting till after January 1. Why add the 2 weeks to your total days on market? The dates right around Christmas and the New Year are probably the worst time to try to sell a home…in any part of the country.


    Even though our market is leaning heavily towards buyers right now, sellers should not be discouraged. Many of my listings have sold in under a month and my last 3 listings sold in just a few days.


    So the real answer to the question is “price it well and it will sell”…anytime of the year.

    Despite having a reputation of implementing quirky laws which supposedly state that, in Fayetteville, it is illegal for dogs to bark after 6:00 pm; or that you cannot mispronounce the State name while you are there; or that it is illegal for a man to beat his wife more than once a month – Arkansas follows standard state and federal laws when it comes to real estate transactions, particularly selling properties.


    What to do


    If you and your family have decided to leave the State of Arkansas and relocate someplace else, you will, most naturally, have to sell your house. Before you put that “For Sale By Owner” sign in your front lawn, you have to make sure you have gone through the preliminaries. Preliminaries include cleaning the house, having it inspected by an independent evaluator, getting a fair estimate (so you won’t over charge or be cheated out of a good price), and of course, conduct minor repairs (as necessary).

    Once all of these have been completed, you are ready to plunge head-on into the exciting world of real estate.


    Forms, forms and more forms


    When selling a house in Arkansas, remember that just like all the states, there are rules and regulations which you must comply with. There are several forms that you need to fill up and most of these, you will need to present to all your potential buyers. Of all the pre-sale forms you are to complete, the most important of these is the property disclosure form.


    You really cannot hide the tiny imperfections of your property (to jack up the selling price). Everything and anything should be disclosed and, if you neglect to be up-front about the true state of your home, you may face legal actions later on. As required by the federal Residential Lead-Based Paint Hazard Reduction Act of 1992, you should disclose if your house was painted before 1972 (before this year, paint had very high lead content).


    The Buying Process


    If you think your battle with forms and legal documents are over once you’ve prepared the disclosure statement, then you are wrong. When someone becomes seriously interested in your property, expect to be bombarded with more forms.


    The first document that you will receive from a prospective buyer is called an offer to purchase. This document states the proposed price, payment terms, and other conditions the buyer has in mind. If you are not happy with the conditions that have been set, you are more than welcome to prepare a counter offer. The process of presenting each other with a counter offer / offer continues until both of you agree on the terms of the sale. When this is achieved, all the conditions set will be summarized in another document, called the Purchase Agreement. Both you and your seller will be legally bound to abide by this document.


    After The Exchange


    If the purchase goes without a hitch, you are paid the agreed upon purchase price and you hand over all the keys and legal documents (land titles, and such) to the new owner. In some cases, you may be asked to pay additional charges (closing costs). These include lawyer’s fees, taxes, and the like.


    Where to Get the Forms


    All the forms needed to complete a real estate transaction in Arkansas can be obtained from the Internet. Although most real estate forms are fairly generic, there are still some documents that are specifically formatted for the State of Arkansas. These are readily available from various websites and you can purchase forms piece-meal or by bulk. It is up to you to decide what is most convenient and more practical for you.

Sign the papers when you and the buyer reach an agreement.


    Step 5. Collect the down payment and hand over the keys


    Once you agree on a price and have signed the papers, collect the down payment and hand over the keys. In most situations, you will continue to own the house and collect payments until the house is paid off, then ownership transfers to the buyer.

    Spring fever, summer doldrums, holiday interruptions, winter icicles, there is always something going on when you are thinking about selling your house. Which leads to the question: When is the best time of year to list/sell my house?

    Seasonally more homes sell in spring and early summer than fall and winter. Roughly 21 percent of sales occur from January thru March (the lowest quarter) and 35 percent between May and July (the busiest three months). However, don’t let the numbers lead you to believe spring/summer is the best time to sell. It’s just the time more people do. There is actually no bad time to sell. Home sales take place every day, 12 months of the year.


    So assuming you have a choice and don’t have an absolute need to sell because of a job transfer or other reason, when should you put your home on the market? As we approach the final months of 2012, here are some thoughts:


    ●Act on what you know is happening in the market, not what you think or perceive the market will be. None of us are good enough to forecast accurately where the market is headed. All we know is market conditions now.


    ●Interest rates are low. Do you know what they’ll be if you wait? Interest rates can impact buyer decisions both positively and negatively.


    ●There is shortage of inventory in the DC metro market right now. Low inventory and strong buyer demand usually equates to strong prices. Do you know what inventory levels will be in six months?


    ●You can determine accurate pricing now. Do you know what prices will do in the next six months? If so, please let me know!


    ●Many people think, “My house will be worth more in the spring so I’ll wait.” If you’re buying another home, so will the home you are buying and if you’re buying in a higher price range, the difference is even bigger. Waiting will cost you more money.


    Here’s an example:


    In this scenario, waiting to sell your home will cost you $3,000.


    ●If you’re not buying another home, how do you know your home will be worth more in the spring? You know what you can get now. Waiting adds risk to your financial equation.


    The fall and winter can be good times to place your house on the market. Consider: Buyers active in the market during this time of the year are serious buyers.     ●You’ve been transferred. Most people react to this situation thinking they need to sell their house. Actually, a better decision might be to hold onto it as a long-term investment. After all, the DC market has traditionally been one of the strongest real estate markets in the country. Perhaps the market where you are going isn’t as good as the market here.


    ●There are several foreclosed properties for sale in your neighborhood. Your home’s asking price will be compared to those the bank is asking. And the bank may be asking significantly less than what you can get for yours if the bank property were not on the market. Perhaps waiting (at least six months for appraisal purposes) until these properties are sold and settled can get you a higher price.


    The bottom line is that as long as your home is priced properly any time of year in the DC metro is a good time to sell your house.
