While it's certainly possible to save money, a single mistake can offset any savings, so it's important to do your homework before putting out that "for sale" sign.

Preparing Your Home for Sale


Take a careful look around your home and yard to identify anything that needs sprucing up or repair. Do the work before listing the house for sale, as properties that are clean, uncluttered and well maintained sell faster and for higher prices. The work you do should be in keeping with the value of your home. The new granite counter-top that's a must-have in a $500,000 home, for example, is overkill in a $150,000 home.


Money Matters: List Price and Commission


Market value is the price a reasonably informed consumer will pay for a home that's been on the market for a reasonable period of time. While only an appraisal can give an opinion of value, a real estate agent bases her price recommendation on a similar tool called a comparative market analysis (CMA). This analysis uses the sales prices of local closed sales to determine the optimum price of the similar home she is about to list for sale. The recommendation may be influenced by the list prices of expired listings (which presumably did not sell because they were priced too high) and active listings (the competition). There are tools that allow savvy sellers to approximate CMAs. Closed sales can be searched on two popular consumer real estate websites (see Resources). Although the information isn't always up-to-date, and it's less complete than the information multiple listing services (MLS) real estate agents use, it can serve as guide. It may be worth investing in an appraisal to help you determine a fair sale price, especially if your market is declining or is otherwise unstable. Your potential buyers almost certainly will be represented by buyers agents, many of whom are leery about working with unrepresented sellers with no professional experience in managing real estate transactions. Consider investing some of the money you're saving by not hiring a listing broker in the buyers agent commission to encourage agents to show your property.


Market Your Property


Real estate agents' primary marketing tool is the MLS. MLS is a cooperative system that allows brokers to share their listings so that other brokers can sell them. The consumer equivalent is the myriad of FSBO sites that help sellers market their own properties, both to potential buyers and to real estate agents (buyers agents often check FSBO sites when MLS listings don't meet their buyers' needs). Some of these companies are brokers that can, for a flat fee, list your home on your local MLS. There are free sites to list your ad (see Resources), although you'll have to repost your ad frequently so it doesn't get lost in the deluge of new ads that appear daily. Other ideas are to hold open houses, post fliers around your town, and mail or hand deliver announcement cards to your neighbors to let them know your house is going up for sale. If your community allows it, a "for sale" sign with your phone number is a must.


Showing Your Home


Showing requests often come with very little notice. The easier your home is to show, the easier it'll be to sell. If you can't be home to accommodate showings, keep a spare key in a lockbox so that buyers agents can show your home at their buyers' convenience.


Know What Forms You Need and Know How to Use Them


Consult an attorney or a do-it-yourself legal site like Nolo.com to obtain the forms you'll need to manage and close your sale. Make sure the forms are specific to your state and that you understand them, as a mistake on a legal document can expose you to serious liability. When in doubt, always ask an attorney.


Evaluating Offers


Offers aren't just about price. You'll also need to consider contingencies (conditions that must be met in order for the sale to close), down payment amount, the buyer's ability to obtain financing or pay cash, and the closing date and other deadlines.


Negotiations


There are two points at which negotiations are likely: during the offer/counter-offer process, and when the buyer makes repair requests based on the inspection reports. These also are the points at which sales often fall apart. Increase your chances of negotiating successfully by building off the things both sides agree on, and by asking for what you need rather than what you want. Resist the urge to consider your buyer an adversary. He isn't. You're partners working together toward a common goal: a successful closing that leaves both of you satisfied that you were treated fairly.

Homeowners can save big bucks by flying solo—and it's not as hard as you might think.

Although most homeowners continue to sell property the same way their parents did—by listing it with a real estate agent—a sizable chunk of Americans are choosing instead to go it alone. The appeal is obvious: By cutting out the middleman, home sellers can save thousands of dollars that would otherwise end up as commission in an agent's pocket.

But can an inexperienced home seller really engineer a transaction in today's turbulent real estate market without the guidance of a professional? Yes indeed, says Greg Healy, vice president of operations at ForSaleByOwner.com, a Web-based company that markets homes for independent sellers. In an interview with U.S. News, Healy underscored the benefits of solo home selling and insisted that it's not as difficult as you might think. Excerpts:


How much money can a homeowner save by not using an agent?


If you cut out all agents—meaning post your own online ad, put out a yard sign, and sold your home on your own—you would essentially cut out on average about 6 percent of commission. On a $300,000 home, that's about $18,000 of savings. There are some markets—and I believe Maine is one of them—where commissions run even higher, I believe 7.5 to 8 percent. Why wouldn't a home seller need to use an agent?


The No. 1 reason that you don't need an agent to sell your house is the rise of the Internet. The Internet has essentially changed the face of real estate. It's essentially leveled the playing field across the market. The Internet allows sellers to easily market their homes to millions of people within minutes. Pricing information—recently sold homes, the competitive landscape of the homes that are being sold—is accessible within seconds on a search engine. Ten years ago, agents controlled all the information, and that's why you had to go to them. Today, it's a completely different ballgame. What about someone who has never sold a home before?


Again, with the Internet allowing access to information, companies like ours provide information and show sellers step-by-step instructions on how to sell your home. That information is easily readable. We provide it—and other services provide it—to bring that confidence to that person who has not done it. But what about pricing a home? Wouldn't a homeowner need a professional to help with that?


Yes and no. First, again, the accessibility of information of automated valuation tools, which we provide free of charge to our customers, provides a pricing estimate. So, independent home sellers can compile all the data that an agent would see, if not more. Other services, like Zillow.com, that do online pricing as well are always a great place to start. Second, an agent is going to give you their perspective based on what they are seeing. They have no true professional training in that aspect. So we recommend to anybody, if you need confidence in the price of your home, get an appraiser to come in for $200 to $300 to provide that professional insight. Again, the agent is not involved in that. Even if you used an agent, you would still bring in an appraiser. How about the legal aspects? Is an average homeowner qualified to take care of that?


We recommend that in every transaction a real estate attorney or a title company—depending on where you are located—represent you and sign off on the final paperwork. There is a myth out there that the agent helps you with this paperwork. They may offer direction, but they are not legally capable to provide that expertise. A lawyer or a professional from a title company—depending on where you are—is a must in any transaction. They are the ones that really help get any seller through the process. What about marketing? Clearly, an agent would help bring more exposure to a home.


Again, that comes back to the two points that we have raised already. The Internet allows you to get in front of people without an agent. Our site has nearly 2 million visitors on a monthly basis looking for homes, so that makes it easy to bypass an agent. In 1997, just 2 percent of buyers used the Internet to search for a home. Right now, it's more than 84 percent. Secondly, when it comes to marketing, agents have fliers. We offer fliers. Consumers can make their own fliers. Signs? We offer signs, or someone can buy one in the store. Agents leverage the multiple listing service (MLS) as their primary "marketing tool," and anybody can access that if they want to pay for it.


It sounds to me that you're saying a real estate agent's job is not all that difficult.


That's true, and remember that a real estate agent license takes under two weeks to get. So after those two weeks, that person can be in charge of the selling or buying of a person's home, which is one of the largest financial assets in a person's life. Are there times when the interests of the agent and the seller are skewed?


Agents are willing to drop the price of the seller's home more and faster than perhaps a seller may want. That's where representing their interests may break apart. And second, they don't want to wait. They want to get the commission. Timing and interest: That's where you might have conflicts. The only other point I would put out there is that the person who owns the home is going to know the home the best. We hear it from customers all the time, "I stopped using an agent because they called me 30 times to ask me questions about my house." You know, "When was the last time you cut the grass?" The sellers are obviously going to be able to answer those questions and save time and hopefully sell your home quicker. So what value do real estate agents bring to this process?


There was an independent study done last summer by two professors from Northwestern University. They compared the prices of homes sold "for sale by owner" versus homes sold by agents. And their two conclusions were, one, FSBO sellers can get the same price, if not slightly more, when they sell their homes. Their second conclusion is that you are essentially paying these agents for the convenience of having someone do the work for you. So for that 6 percent commission, they'll do the work—bring the real estate attorney, do the showings, field calls for you, be at your house if someone wants to see it. But these are all services that homeowners could do for themselves?

Probate is the legal process that involves the transfer of property from an estate to the property holder’s beneficiaries. As an executor of an estate you may have to sell off real estate held by the estate not directly willed to a specific beneficiary. The probate court handling the estate will then split the proceeds from the sale among the beneficiaries. Making a valid sale of the property requires that you follow strict sales procedures laid out in the real estate law covering your location. While these particular procedures are for California probate sales, the general process of selling real estate during probate is a consistent one across jurisdictions.

Appraise the property that you wish to sell during probate using an independent certified appraiser. You can find an appraiser in the local phone book or by asking an area real estate agent or real estate attorney for a recommendation.


Obtain a petition to sell real estate from the court. Fill out the petition, making sure to include all information pertaining to the property sale, including sale methods whether by auction or by an open market sale. File the petition along with the independent appraisal with the court and await approval from the probate court allowing the sale.


Place the property up for sale and accept an offer from a buyer. Make sure you inform the buyer that the acceptance is conditional on court confirmation.


Petition the court for a hearing confirming the sale. The wait before a hearing varies according to the current load on the court calendar. Most hearings take place within 20 to 40 days.


Arrange for a 10 percent deposit on the purchase price from the buyer before the scheduled date of the court hearing.


Advertise the sale along with the offered price from the buyer with a local newspaper. The advertisement informs the public of the sale in order to allow for open bidding at the court hearing among other interested parties. The purpose of the sale is to gain the best price for the estate, and the open bidding process aids toward this end.


Attend the court hearing. Wait for the bidding process to proceed. Bids proceed in $500 increments above the intended original buyer’s offer, with the buyer allowed to bid as well. All bids are unconditional, and the winner must present a cashier’s check to the court for a deposit after confirming the bid.


Refund the deposit to the original buyer if there is a confirmation of a new buyer’s overbid. Apply the deposit to the purchase price of the property if there is no overbidding and if the court confirms the original buyer’s price.


Complete the sale by closing the contract. Make sure the financing is sufficient to cover the cost of the property and the full amount goes into the estate fund.

Former MLB star Jose Contreras is walking away from his Alva, FL, home, which is on the market for $2 million. The pitcher bought the 3-acre parcel with a 6,500-square-foot home in 2008 for $1.8 million, according to property records.


The 46-year-old had his start playing with the Cuban national team and in the Cuban National Series, before defecting to the United States in 2002 and signing with the New York Yankees. In 2004 he was traded to the Chicago White Sox (with whom he won the World Series in 2005), and it was during his time with the Sox that he purchased this off-season vacation home.


The hurler’s retreat is a real catch. Built in 1999, the “charming estate” is located along the banks of the Caloosahatchee River. The property comes with a private dock with boatlift, 200 feet of river frontage, and access to the Gulf of Mexico.

The costs for the renovation can be reduced due to government and European subsidies, especially if you are a young couple. If you are really interested, you should also consider that normally there's a time limit for renovations, that goes from 6 months to a couple of years.


Salemi, a town in Sicily that first had this idea with its mayor Vittorio Sgarbi, has failed in carrying out the project for various reasons. Also Carrega Ligure (in Piedmont) and Lecce dei Marsi, despite the initial enthusiasm, had to give up the project due to the Italian bureaucracy.


Other towns succeeded.


In Maremma a Montieri, Grosseto, 2 of the 10 available houses were sold. Truth is, they didn't cost 1 euro, but 12,000. Nevertheless, including the renovation the new houses cost about 50,000 euro, which is still a deal, considering today's real estate market.


The most successful projects seem to be those on the islands.


In Gangi, Palermo, the municipality received about 1,000 requests, and 100 old houses were sold. Officials are sure this will bring back to life this old town.


Regalbuto, at the foot of Mount Etna, has already received many offers before the official announcement was made.


In Sardinia, Ollolai with its 2,000 inhabitants has already sold the first house at one euro, and is expecting to sell two more. The municipality of Nulvi, at just 15 minutes from the beach, has 6 available houses. Here you are also asked to use local people to renew the house, but with 20,000 euro you could have the house of your dreams at only 500 meters from the sea.


This might sound impossible, but instead of letting the buildings fall down and the towns disappear, municipalities in Italy are ready to sell the houses at really low prices.


With a little investement and a bit of luck, you could become the owner of a newly refurbished house in your dreamland.

There are 20 properties carrying the €1 price tag in Gangi, a 12th-century village in Palermo province. As the years have passed the number of villagers has fallen to around 7,000, as Italians move away in search of work.

Now local authorities are trying to revitalize the village, by drawing foreigners in to take over the abandoned homes. But for Marie Wester, the Sicilian Houses broker selling the properties abroad, Gangi remains “a local secret”.


“Municipalities often don’t have the skills to market properties abroad, but they want some life there,” she told The Local.


Wester described the one-bedroom properties as being in “bad condition”, because they have either been abandoned by emigres or donated to the municipality by locals who can no longer afford the upkeep.


“They want foreigners to come in and take over the properties, because there isn’t much work around here so people are moving away. It’s a beautiful project,” she said.


In addition to the €1 price, Wester was clear that there are other costs involved. Purchasing costs amount to around €6,000, which she said was the norm for buying any property in Sicily.


Buyers also have to agree to renovating the property within five years, with the higher costs coming with structural work.

“You need to have someone to fix the roof, the floors, the sewage and water. These more difficult things would cost around €35,000, then the rest you can do yourself and have a house that’s completely like new!” Wester said.


Aside from having a bargain property, she said picking up a €1 townhouse also brings people to the “authentic Sicily”.


“It’s fabulous. You have the old-fashioned way of life; people are friendlier and the food is excellent!


“If you go to a place like Gangi, you have friends immediately and become the centre of attention. People come to help. You will be part of the community, not a stranger,” Wester said.

    Avoid unusual forms of payment, or being rushed.


    It can be risky to use a wire transfer service (such as Western Union or MoneyGram) or online escrow service to send a deposit, earnest money, down-payment, rent or other money relating to a rental or housing transaction. Use great caution if someone suggests you should send money in this way. Also be wary of being rushed into a decision to rent or buy an apartment or other housing, or to send a deposit, earnest money, down-payment, rent or other money. These are significant decisions, transactions and payments; if someone is rushing you, that could be a signal of a potential fraud or a scam.


    Avoid renting or buying an apartment or other housing without actually seeing it first.


    Before sending a deposit, earnest money, down-payment, rent or other money, you probably should visit and see the property first and confirm that everything about the property matches what was advertised, described or represented to you. For personal safety and other reasons, consider having one or more friends or companions accompany you on your visit(s) and inspection(s). Get a specific name and contact information.     Particular SCAM Alert!


    Sometimes the good name realtor.com,® Move or other reputable websites or companies could be used as part of a property rental or purchase scam. For example, a scammer (using Craigslist.com for example or another similar site) may offer to sell a home or rent an apartment to a consumer. The scammer leads the consumer to believe that realtor.com,® Move, Move.com or Moving.com, or an affiliate or business partner of one of them is functioning as an intermediary – perhaps to receive or hold deposits, down-payments, rent or other money from the consumer. The scammer might also tell the consumer that he or she will be able to receive delivery of the keys to an apartment or property from realtor.com,® Move or others. The scammer might also instruct the consumer to send money by way of a wire transfer service (such as Western Union or MoneyGram), an online escrow service or some other purported agent of the scammer or of realtor.com,® Move or others. None of this involving realtor.com® or Move is true. Beware of any transaction or circumstance that sounds anything like this or involves any features like this.


    Another type of scam can involve a potential tenant or home-buyer who finds a home or rental listing on websites such as Craigslist or other classified ad websites, but the listing is not legitimate. The scam listing might display the real address of a house or apartment that recently was up for sale or rent, and may even display actual photos for that property from when it was on the market. The bogus listing might also include the name of a practicing REALTOR® in the area. But the phone number or email address included in the bogus listing is set up to lead to the scammer, not to the actual owner of the property nor to the actual REALTOR® displayed in the listing. When the consumer responds to the email address shown in the listing, they might receive a reply stating that the owner or property manager is out of the country right now, but realtor.com® or Move (or another reputable company) will be handling or helping with the remittance, collection or holding of funds. The reply might also state that such company will be sending out keys to the property to the renter or buyer. Again, none of this involving realtor.com® or Move is true. The reply might also request a wire transfer funds through a fund exchange company (such as Western Union or MoneyGram). To try to make the consumer believe the transaction is legitimate, the scammer might also use ‘doctored’ email addresses or domain names that in part appropriate name or brand of a reputable company (for example, something like “realtor.com-customer-care@gmail.com” - which is NOT a legitimate realtor.com® email address), and might also use such companies’ logos and trademarks in emails that they send to the consumer. Be on guard against listings, transactions or circumstance like this.


    You can report any such circumstance to the authorities by using one of the suggestions below.


    To Report Actual or Suspected Fraud or a Scam


    If you wish to report actual or suspected fraud, abuse or scams to the authorities, here are some suggestions for you to consider:


    Report the incident to the local law enforcement authorities – either where you are located, where the person you are dealing with is located or where the property in question is located. Or you can report the matter to local law enforcement in all three places if you are unsure which is most appropriate.
